Restaurant clients who have executed a service agreement with Elev8ed Media Hub LLC are subject to the terms of that separate agreement, which governs service delivery, pricing, data handling, and client-specific obligations.

The Site and all of its content, features, and functionality — including but not limited to text, copy, graphics, photographs, logos, icons, illustrations, audio and video clips, data compilations, software, and the selection, arrangement, and coordination of these elements — are the exclusive property of Elev8ed Media Hub LLC or its licensors and are protected by United States and international copyright, trademark, trade secret, and other intellectual property laws.

The Elev8ed Media Hub name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Elev8ed Media Hub LLC. You may not use any of these marks without the prior written permission of Elev8ed Media Hub LLC. All other names, logos, and brands appearing on the Site are the property of their respective owners.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site solely for your personal, non-commercial informational purposes. This license does not include any right to: (a) modify or copy the Site's content; (b) use any content for commercial purposes; (c) reverse-engineer any software or system underlying the Site; or (d) remove or alter any copyright, trademark, or other proprietary notices.

In all cases, Elev8ed Media Hub LLC's total aggregate liability to you for any and all claims arising out of or related to your use of the Site will not exceed:

If you have not paid any fees to Elev8ed in that period, our total aggregate liability is limited to one hundred dollars ($100.00).

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. To the extent such exclusions or limitations are not permitted by applicable law, they will apply only to the fullest extent permitted.

You agree to defend, indemnify, and hold harmless Elev8ed Media Hub LLC and its members, managers, officers, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms
• Your use of the Site in a manner not expressly authorized by these Terms
• Your violation of any applicable law, regulation, or third-party right, including intellectual property rights
• Any content, information, or materials you submit, transmit, or make available through the Site

This Agreement is governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws principles.

Any legal action or proceeding arising out of or relating to these Terms or your use of the Site is brought exclusively in the state or federal courts located in San Diego County, California. You consent to the personal jurisdiction of those courts and waive any objection to venue in those courts.

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site must be brought on an individual basis only. You agree that you will not bring or participate in any class action, collective action, or representative action against Elev8ed Media Hub LLC arising out of or related to the Site or these Terms.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU WAIVE YOUR RIGHT TO BRING OR PARTICIPATE IN ANY CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION OR PROCEEDING AGAINST ELEV8ED MEDIA HUB LLC, WHETHER IN COURT OR IN ARBITRATION.

Before initiating any formal legal proceeding, you agree to first contact Elev8ed Media Hub LLC at [email protected] and provide a written description of the dispute. The parties will attempt in good faith to resolve the dispute within thirty (30) days of receipt of that written notice.

We reserve the right to modify these Terms at any time at our sole discretion. When we make material changes, we will update the "Last Updated" date at the top of this page. For significant changes, we may also provide additional notice on the Site or through other means we consider appropriate.

Your continued use of the Site after the effective date of any revised Terms constitutes your acceptance of those changes. If you do not agree to the revised Terms, you must stop using the Site.
